San Francisco County Superior Court, Case No. CGC-15-544578

This class action was filed on behalf of non-exempt, hourly employees who worked at any of the Amber India family of restaurants in San Francisco, Mountain View, Los Altos, San Jose and/or Palo Alto at any time during the period of February 27, 2011 through June 18, 2015. The workers seek damages and penalties for missed meal and rest periods and derivative violations of the California Labor Code. The workers allege that they were not authorized or permitted to take off-duty rest breaks, and they were not provided off-duty meal breaks, along with other related claims. Defendants deny that they violated any laws, and assert that the workers were paid all wages owed to them and that they took all of the breaks to which they were entitled.

The Court has granted preliminary approval and scheduled a hearing to consider the workers’ motion for Final Approval of the settlement on February 16, 2018, at 2:00 p.m. The Court’s preliminary approval order and other relevant documents can be viewed below:
