This class action was filed on behalf of Respiratory Therapists ("RTs") who employed by ValleyCare Health System during the period February 27, 2008 through February 28, 2012. The RTs seek damages for alleged missed meal periods and rest breaks. The RTs allege that they were not authorized and permitted to take rest breaks and that they were not provided with off-duty meal periods, along with other related claims. Defendants deny that they violated any laws and assert that the RTs took all of the breaks to which they were entitled. The Court preliminarily approved a settlement of the case on October 16, 2013, and the Final Approval Hearing is schedule for January 24, 2014 at 8:30 a.m. in Department 21 of Alameda County Superior Court.
